Abbie, Jerry, Tom , Rennie, David, Lee, John, and Bobby plan to demonstrate during the Democratic National Convention in Chicago in August 1968. They are caught and charged with attempting to instigate a riot five months later. Attorney General John N. Mitchell names Tom Foran and Richard Schultz as investigators, while William Kunstler and Leonard Weinglass represent all of the defendants save Seale.

Judge Julius Hoffman expresses strong bias against the prosecution, claiming that he and Abbie Hoffman are unrelated. Seale’s lawyer, Charles Garry, is unable to attend due to sickness, therefore Judge Hoffman has appointed Kunstler to defend him. Both Kunstler and Seale reject this assertion. Seale gets assistance from Fred Hampton, which Judge Hoffman interprets as legal assistance. Abbie Hoffman is openly hostile to the court.
